(5) Reason: In order to minimise the impact of development on trees protected by a tree preservation order. But: The council allowed the access road to cross the root spread of such a tree.  (6) Reason: In order to minimise the impact of development on trees protected by a tree preservation order. (8) Condition: The soil levels within the root spread of trees/hedgerows to be retained shall not be raised or lowered. But: The entrance drive passes over the root spread of a tree protected by a Tree Preservation Order.  

The sketch shows the entrance road  (marked in red) crossing the root spread of a tree (marked in blue) subject to a Tree Preservation Order.  This was shown on the plans and approved by the Council!  The Case Officer was Ms. J. Watkins.
